LorryLand Returns & Warranty Policy

At LorryLand, we stand behind the quality of the parts we sell.  We offer a 60-day warranty on faulty parts. 

If a part supplied by us is found to be faulty, LorryLand will, at its sole discretion, repair, replace, refund or issue a credit for the part. Where a warranty claim is accepted, we will also reimburse the reasonable cost of return freight.  We may, at our sole discretion, accept the return of non-faulty parts. Approved returns of non-faulty parts will incur a 20% restocking fee based on the original invoiced value. Freight charges are non-refundable and you must cover the cost of the return freight.  This Returns & Warranty Policy forms part of LorryLand's General Terms & Conditions of Sale and applies to all warranty claims, returns and refunds unless otherwise agreed by LorryLand in writing.  

1. Warranty Period  

1.1 All warranty claims and return requests must be made within 60 days of the original invoice date.  
1.2 No warranty claim or return will be accepted after this period.  

2. Return Authorisation  
2.1 All returns must first be approved by LorryLand.  
2.2 Customers must not return goods without prior authorisation.  

3. Inspection Before Installation  
3.1 The customer is responsible for inspecting all parts before installation to ensure the correct part has been supplied, the part is suitable for the intended application, and there is no obvious damage or defect. 

Any issue that would have been apparent upon reasonable inspection must be reported before installation. Failure to do so will void the warranty.  

4. Correct Diagnosis  
4.1 The customer is responsible for correctly diagnosing the fault with their vehicle.  
4.2 LorryLand warrants only that the part supplied is not faulty. We do not warrant that the part purchased will rectify the customer's diagnosis or repair the vehicle.  

5. Suitability  
5.1 The customer is responsible for ensuring the supplied part is suitable for the intended application before installation.  
5.2 Where parts are supplied using information provided by the customer, LorryLand accepts no responsibility for incorrect identification resulting from inaccurate or incomplete information.  

6. Installation  
6.1 Parts must be installed correctly and in accordance with the manufacturer's recommendations.  
6.2 LorryLand is not responsible for damage caused by incorrect installation, incorrect adjustment, misuse, abuse, modification after supply, failure to follow manufacturer specifications, use of the part for an unintended purpose.  

7. Modification of Parts  
7.1 If a part has been fitted where modification was required, painted, cut, drilled, welded, machined, fabricated or otherwise altered, the part will be deemed to have been accepted by the customer and is not eligible for return or exchange. 
7.2 Parts modified by LorryLand at the customer's request (including chassis cuts, cab cuts and other custom modifications) are not returnable, unless faulty.  

8. Used Parts  
8.1 Unless expressly stated otherwise in writing, all parts supplied by LorryLand are used parts.  
8.2 Normal wear and tear consistent with the age, mileage and previous use of the part is not considered a fault.  
8.3 Surface rust, scratches, paint fade, cosmetic marks and similar signs of previous use do not constitute defects.  

9. Engines, Gearboxes and Differentials  
9.1 Engines, gearboxes and differentials must be inspected prior to installation.  
9.2 Customers are responsible for ensuring appropriate servicing and preparation before the part is put into service, including replacing or inspecting oils, filters, seals, gaskets, belts, hoses and cooling system components where appropriate.  
9.3 Warranty does not cover damage caused by overheating, lack of lubrication, coolant loss, contamination, incorrect installation, failure to replace service items, or failure to correctly prepare the component prior to operation. 

10. Electrical Components  
10.1 Warranty on electrical components does not cover damage caused by incorrect diagnosis, incorrect installation, voltage spikes, wiring faults, water ingress, incompatible programming, or faults elsewhere in the vehicle. 

11. Freight Damage  
11.1 Freight damage, shortages or incorrect deliveries must be reported within 48 hours of delivery.  
11.2 Customers should retain all packaging until the matter has been resolved. 

12. Incorrectly Ordered Parts  
12.1 Where the incorrect part has been ordered because of information supplied by the customer, or through direct purchase through our website, any return is entirely at LorryLand's discretion and, if accepted, will be treated as a non-faulty return and subject to the applicable restocking fee.  

13. Provision of Information 
13.1 At LorryLand’s request, you must provide LorryLand with all available diagnostic data, ECU downloads, telematics data, fault codes, exports, service records, photographs and any other information we reasonably request to assist in determining the cause of any alleged fault, failure or damage. Failure to provide this information may result in your warranty claim being declined where it prevents us from properly assessing the claim. 

14. Non-Faulty Returns  
14.1 Approved non-faulty returns: 

  1. incur a 20% restocking fee; 
  2. must be returned at the customer's expense; 
  3. must be complete; and 
  4. must be returned in substantially the same condition as supplied. 

15. Inspection of Returned Goods  
15.1 Returned goods may be dismantled, inspected and tested by LorryLand or an independent specialist.  
15.2 If testing establishes that no fault exists, the warranty claim may be declined.  
15.3 Where no fault is found, return freight and any inspection costs may be charged to the customer.  

16. Limitation of Liability  
16.1 LorryLand's total liability for any claim relating to goods supplied is limited to the amount paid for those goods.  
16.2 To the fullest extent permitted by law, LorryLand is not liable for any indirect, consequential or incidental loss whatsoever, including but not limited to labour; workshop charges, installation costs, removal costs, towing, recovery costs, freight (other than approved warranty return freight), storage, accommodation, travel, hire vehicles, vehicle downtime, loss of use, loss of production, loss of profits, loss of contracts, loss of business, or any other consequential loss whatsoever. 

17. Refunds  
17.1 Refunds or credits will not be processed until the returned goods have been received and inspected.  
17.2 Approved refunds may be processed on the 20th day of the month following the later of: 

  1. receipt of the returned goods; or 
  2. issue of the credit note. 

18. Ownership of Returned Goods  
18.1 Where LorryLand provides a refund or replacement, ownership of the returned goods immediately passes to LorryLand. 

19. Relationship with General Terms 

This Returns & Warranty Policy should be read together with LorryLand's General Terms & Conditions of Sale. To the extent of any inconsistency, this policy applies specifically to warranty, return and refund claims. 

LorryLand General Terms & Conditions of Sale 

1. Application 

These Terms & Conditions apply to all quotations, orders and sales by LorryLand unless otherwise agreed in writing. 

LorryLand is the trading name of The Roman Empire Limited. 

2. Quotations 

Quotations are valid for 7 days unless otherwise stated, are subject to prior sale, and may be withdrawn or amended before acceptance. 

3. Orders 

Orders are subject to acceptance by LorryLand. An order is not binding until confirmed by LorryLand. 

4. Pricing 

All prices are exclusive of GST unless stated otherwise. Pricing, descriptions and availability may change without notice. LorryLand may correct pricing, typographical, inventory or administrative errors and cancel or amend an order where necessary, refunding any payment received or offering the customer the option to proceed at the corrected price. 

5. Payment 

Unless a credit account has been approved, payment is due before dispatch or collection. Sales on account are due on the 20th of the month following invoice. Overdue accounts may incur interest at 2% per month together with all reasonable debt collection and legal costs. 

6. Credit Accounts 

Credit facilities may be withdrawn or varied at any time. 

7. Delivery 

Delivery dates are estimates only. Risk passes to the customer upon delivery or collection. Delays do not entitle the customer to cancel an order or claim compensation. 

8. Inspection 

The customer must inspect goods upon delivery and notify LorryLand within 48 hours of any visible damage, shortages or incorrect goods.  Failure to do so may void our warranty. 

9. Title 

Ownership of goods remains with LorryLand until all monies owing by the customer have been paid in full. 

10. PPSA 

The customer grants LorryLand a security interest in all goods supplied and proceeds of those goods under the Personal Property Securities Act 1999. The customer will do all things reasonably required to enable LorryLand to perfect and maintain that security interest. 

11. Product Information 

Images, descriptions and compatibility information are provided as a guide only. Customers are responsible for confirming suitability before purchase. 

12. Website & Catalogue etc 

Website, catalogue and any content we provide may contain errors and may be updated without notice. 

13. Intellectual Property 

All website content, photographs, catalogues, branding and product descriptions remain the property of LorryLand and may not be reproduced without permission. 

14. Limitation of Liability 

Except as required by law, LorryLand's liability is limited to the purchase price of the relevant goods. LorryLand is not liable for indirect or consequential losses of any kind whatsoever. 

15. Consumer Guarantees Act 

Where goods are supplied for business purposes, the parties agree to contract out of the Consumer Guarantees Act 1993 to the fullest extent permitted by law. 

16. Privacy 

Personal information will be collected, used and disclosed in accordance with LorryLand's Privacy Policy. 

17. Force Majeure 

LorryLand is not liable for delay or failure to perform caused by events beyond its reasonable control. 

18. Electronic Communications 

Electronic communications satisfy any requirement for written notice under these Terms. 

19. Variation 

LorryLand may amend these Terms by publishing updated terms on its website. Updated terms apply to future orders. 

20. Severability 

If any provision is unenforceable, the remaining provisions remain in force. 

21. Entire Agreement 

These Terms, together with the Returns & Warranty Policy, Privacy Policy and catalogue terms, constitute the entire agreement unless otherwise agreed in writing. 

22. Governing Law 

These Terms are governed by New Zealand law and the New Zealand courts have exclusive jurisdiction.
